This General Privacy Policy applies to all persons accessing our website, dealing with us, or from whom we otherwise collect personal information. We also collect personal and credit information provided by persons applying for or receiving credit from us and, in doing so, endeavour to comply with Australian Privacy Law and the Credit Reporting Code.
All persons applying for or receiving credit from us are further protected by our Credit Information Privacy Policy (Part 2 below). Anyone applying to vary payment terms on grounds of hardship is additionally protected by our Hardship Privacy Policy.
Pseudonyms
You are not required to provide your name or personal information if you do not wish to, and you are free to use any name permitted by law. However, we will not deal further with you without obtaining your real name and other verifiable personal information.
The Kinds of Personal Information We Collect
By accessing our website or dealing with us, you agree to our collection of personal information. As a result of your website visit, we may collect:

How to Access Your Personal Information

If we are unable to grant access to information, we will provide our reasons in writing within a reasonable time. Reasons may include where providing the information would reveal personal information about another individual, pose a threat to health or safety, is not permitted by law, or would reveal commercially sensitive internal information.
Correcting Your Personal Information
If you believe any personal information we hold about you is incorrect, please contact us by telephone, email or in person, identify yourself, and advise us what information is incorrect and how you want it changed.
If we cannot agree to the requested change, we will provide our reasons in writing within 14 days.

Changes to This Policy
From time to time we may make changes to this General Privacy Policy due to changes in the law, changes in technology, or changes to our systems. We will notify such changes on our website. Where changes may affect you in a particular way and you have a credit contract with us, we will notify you as required by Australian Privacy Law.
Part 2 — Credit Information Privacy Policy
This policy applies if you apply for credit, receive credit, or we otherwise hold credit information about you. It is subject to and in addition to our General Privacy Policy above.
Introduction
Breezy Loans Pty Ltd endeavours at all times to comply with the Privacy Act 1988, Australian Privacy Principles and the Credit Reporting Code, together referred to as "Australian Privacy Law."
This Credit Information Privacy Policy applies to you if you apply for one of our credit products, receive credit from us, or we otherwise hold credit information about you.
What Credit Information Do We Collect?
In addition to the information collected under our General Privacy Policy, if you apply for credit we may collect:
- Identification information
- Financial information — income from all sources, employment status, assets, expenses, debts, and at least 90 days of bank statements
- Consumer credit liability information — details of existing credit accounts including type, opening/closing dates, credit limits, and terms
- Credit application information — type of credit sought and amount
- Default information — overdue payments of more than 60 days after appropriate notice
- Court proceedings information — any Australian court judgment made against you in relation to credit
- Personal insolvency information — records from the National Personal Insolvency Index
- Serious credit infringement information — relating to fraud, evasion of payments, or loss of contact
How We Collect Credit Information
We collect credit information in the same ways described in our General Privacy Policy, and additionally collect it directly from you through your credit application and from credit reporting bodies.
How We Hold Your Credit Information
We hold and keep secure your credit information in the same ways as all personal information as described in our General Privacy Policy.
How We Disclose Your Credit Information
In order to obtain credit information from credit reporting bodies, we may be required to disclose to them certain credit information we hold. Those bodies may include that information in reports provided to other credit providers.

How We Use Your Credit Information
In addition to the purposes described in our General Privacy Policy, we collect, hold, use and disclose your credit information to:
- Assess your credit application and that of any proposed guarantors
- Manage your credit contract
- Consider any application for hardship variation of payments
- Collect any debt or enforce rights arising under your credit contract
- Assist you if we consider you may be at risk of default
- Participate in the credit reporting system
- Identify you as required under Anti-Money Laundering/Counter-Terrorism Financing legislation
- Deal with complaints through our Internal or External Dispute Resolution processes
We will not disclose your credit information to any party for the purposes of direct marketing.
Overseas Recipients of Credit Information
We may supply your credit information to overseas recipients (such as those in the United States of America) as part of our information technology systems. We shall not provide credit information or credit worthiness/eligibility information to overseas entities except as permitted by Australian Privacy Law.
Accessing Your Credit Information
You may access your credit information held by us in the same way as described in our General Privacy Policy. There is no charge to make a request for access, but we may apply an administration fee for providing that access.
We cannot give you access to credit information held about you by any credit reporting body. Please refer to the privacy policy of the relevant credit reporting body.
Correcting Your Credit Information
You may apply to correct the credit information we hold about you in the same way as described in our General Privacy Policy. We will respond and/or provide reasons within 7 business days and make our decision no later than 30 days after receiving your request.
If we have supplied credit information which we have agreed to correct to a credit reporting body, we will notify that body within 7 business days of making that decision.
Complaining About How We Handle Your Credit Information
If you are not satisfied with how we have dealt with your credit information, please contact our Privacy Officer as described in our General Privacy Policy. If unsatisfied with our Internal Dispute Resolution process, you may refer your complaint to our External Dispute Resolution scheme (AFCA) or the Office of the Australian Information Commissioner as described above.
Changes to This Policy
We may change this Credit Information Privacy Policy for the same reasons, and in the same manner, as described in our General Privacy Policy above.
